What is the Probate Process?

The probate process is a legal process which the court supervises. During probate, a deceased person’s bills, debts, or taxes are first identified. The second step is to distribute those debts or assets to the proper individuals.
Once a Petition for Probate is filed with the probate court, a hearing will typically be set for several weeks later. At the probate hearing, the validity of the decedent’s will is established, and the court appoints a personal representative to administer the decedent’s estate. The entire process can take several months to complete, and it is best to have an attorney on board assisting you throughout the process.


What is meant by Probate Administration?

It is extremely important to have an experienced attorney assisting you throughout each step of the probate administration process. This is the process by which a decedent’s will is submitted to probate, debts are paid, property is liquidated, and any disputes surrounding the decedent’s estate are settled. The primary steps of the probate administration process include all of the following:

  • The decedent’s will is filed in the probate court and is then submitted to probate.
  • The family will need to go through the Probate process if the decedent left no Will.
  • All of the debts and assets of the decedent are identified and inventoried.
  • An individual is appointed to serve as personal representative (PR) or executor of the decedent’s estate.
  • All of the decedent’s property and assets are valued and are subsequently distributed according to the decedent’s will.
  • The decedent’s property is liquidated and sold as necessary.
  • Any disputes surrounding the distribution of assets and liabilities are resolved.
  • All of the estate’s final bills and debts are paid to any creditors of the estate.
  • The proper state and federal tax returns for the estate are prepared and filed with the appropriate governmental agency.
